Luis A. Leitzelar will be presenting at the upcoming DRI Class Actions Latest Developments in Law and Practice seminar to be held on Friday, July 26, 2013 at The Willard Washington, D.C. in Washington, D.C.  Mr. Leitzelar will be presenting, "Ending the Case Before It Starts: Strategies for Pretermitting Class Actions at the Outset."  In his presentation, he will discuss the Court's consideration of Genesis Healthcare and whether a Rule 68 offer of judgement to the named plaintiff in a FLSA collective action renders the case moot and nonjusticiable.  His presentation will examine that question, along with other strategies for pretermitting class actions, such as the use of "limited merits discovery" prior to reaching certification; challenges to standing or ascertainability of the class; Lone Pine orders; and issues related to the class definition and the use of subclasses.
