Jones Walker Team Obtains Preliminary Injunction

A team of Jones Walker attorneys, led by litigation partner Justin Ourso and composed of partner David Kerth, associate Chris Martin, and paralegal Angeli Bergeron, obtained a preliminary injunction on behalf of a Jones Walker technology and manufacturing client against a former employee who left and began competing using technology developed at the client's research and manufacturing facilities. The injunction prohibits the former employee, his partner, and their entity from manufacturing and selling competing dehumidification equipment even though the client did not have a noncompetition provision in the former employee's employment agreement. Earlier, at the inception of the action, the team obtained an electronic discovery order for the production of the defendants' computers and their imaging by experts immediately upon the defendants being served with the petition. The preliminary injunction order is now on appeal and the action is proceeding toward a trial on the merits of a permanent injunction and damages.
