Amy Winters is a partner in the firm's Business & Commercial Litigation Practice Group. She joined Jones Walker in 1994 and has been a partner since 2001. With more than 20 years of legal experience, Ms. Winters focuses her practice on the health care industry, with clients including physicians, dentists, nurses, hospitals, long-term care facilities, and pharmaceutical companies.
Ms. Winters represents health care clients in administrative and civil proceedings in state and federal courts, including medical professional liability litigation and peer review, credentialing, and licensure matters. She also handles pharmaceutical products liability actions, including class actions and multi-district litigation. Ms. Winters' practice also focuses on general litigation matters, such as personal injury and property damages actions, including premises liability and motor vehicle accidents; products liability; environmental and toxic torts; contract disputes, including breach of contract, trade secrets, and noncompete provisions; and workers' compensation. She also provides general counsel and advice to clients concerning insurance coverage, employment contracts, employee relations, contract negotiation and construction, joint ventures, physician organizations and business arrangements, health care fraud and abuse, health care compliance, and health care professional licensure.
She provides guidance and advice regarding physician contracts, risk management issues, HIPAA compliance, including breach notification requirements, and fraud and abuse issues. In addition, she also represents pharmaceutical clients in drug and device products liability actions in both state and federal court, and has represented both health care providers and health care insurance companies in litigation regarding payment issues.
Ms. Winters is a member of a number of professional associations, including the American Health Lawyers Association, the Louisiana Hospital Association, the Louisiana Association of Defense Counsel, the American Bar Association, and the Louisiana State Bar Association.
