Amy Winters is a partner in the firm's Business & Commercial Litigation Practice Group. She joined Jones Walker in 1994 and has been a partner since 2001. With more than 25 years of legal experience, Ms. Winters focuses her practice on the healthcare industry and general litigation.

Ms. Winters' healthcare clients include health plans and all types of healthcare providers, including physicians, dentists, psychologists, counselors, nurses, hospitals, hospice providers, and long-term care facilities.

Ms. Winters’ litigation practice includes defense of healthcare providers in licensing and credentialing matters in state and federal courts as well as administrative proceedings before hospital peer review committees and licensing boards. She also defends healthcare providers in medical professional liability actions, including malpractice and privacy actions, and in contract disputes involving practice separation and restrictive convents.

Ms. Winters provides advice and counsel in connection with healthcare regulatory compliance matters to both health plans and healthcare providers. Ms. Winters assists healthcare providers with contracting matters, including drafting and negotiation of employment and professional services agreements and medical director agreements. She also provides guidance to both healthcare providers and health plans regarding payor-provider relations, contracts, and reimbursement.

Ms. Winters assists Covered Entities and Business Associates to create comprehensive HIPAA compliance programs. In this context, she works with Covered Entities and Business Associates to assess and develop customized privacy and security practices, as well as related policies and procedures that comply with the HIPAA standards. She drafts and negotiates Business Associate Agreements, for Covered Entities, Business Associates, and subcontractors. Ms. Winters also assists clients in HIPAA breach investigations and responses, including breach notification reports to individuals and regulatory authorities.

Ms. Winters' litigation practice also includes defense of clients in general litigation matters, such as personal injury, property damage, products liability, and environmental and toxic torts.
