Energy, Environment & Natural Resources Practice

Marjorie McKeithen is a partner in the firm's Business & Commercial Transactions Group and co-chairs the firm's Energy, Environment, and Natural Resources Industry Team. She affiliated with the firm after serving as Secretary of the Louisiana Mineral and Energy Board and Assistant Secretary of the Louisiana Department of Natural Resources, Office of Mineral Resources, where she oversaw the granting and administering of mineral leases, storage agreements and alternative energy agreements on state-owned lands and water bottoms. While serving as Secretary of the Louisiana Mineral and Energy Board, Ms. McKeithen undertook a comprehensive revision of Louisiana's statutory scheme relating to leases for natural gas storage and carbon dioxide storage.

In addition to her traditional oil and gas practice, Ms. McKeithen currently serves as counsel to a number of pipeline companies and gas storage facilities, including both salt dome and depleted reservoir storage facilities. She also serves as counsel for a number of renewable energy companies.

After clerking with the Honorable Frank J. Polozola in the U.S. District Court for the Middle District of Louisiana, Ms. McKeithen was in the private practice of law from 1992–2006 with a concentration in civil litigation, including environmental and toxic tort litigation. Previously, she served as campaign manager to her father, W. Fox McKeithen, during his initial campaign for the office of Louisiana Secretary of State.

Ms. McKeithen received her juris doctor degree from the Paul M. Hebert Law Center, Louisiana State University, in 1991, and her Bachelor of Science in Petroleum Land Management from Louisiana State University in 1987. She is currently an appointed Member of the Interstate Oil and Gas Compact Commission and serves on the Board of the Louisiana Oil & Gas Association. She has also been an active participant in Women of the Storm's grassroots volunteer efforts to return funds to the Gulf states for coastal restoration efforts.

• Counsel for natural gas storage company in connection with financing, construction, development and permitting of a $200 million conversion of depleted reservoir for natural gas storage facility providing advices with respect to $115 million credit facility and related financing documents, negotiation of and closing on fee, leasehold, options, swaps and servitude acquisitions in connection with related pipelines, pipeline facilities, access roads, well sites, storage rights, review of all title matters, review of all mineral title matters, negotiation and acquisition of gas storage rights,  negotiation and acquisition of geological and geophysical survey rights, including seismic rights, negotiation with landowner hold-outs, assistance with permitting, public hearings and addressing related issues, and assistance with governmental relations and expropriation/condemnation proceedings for pipeline right-of-way.
• Counsel for natural gas storage company in connection with $125 million term loan conversion for $230 million salt cavern natural gas storage facility providing advices in connection with credit facility conversion, issuing mineral and regulatory opinions, review of title and survey matters and addressing related issues, obtaining water rights from the private and public sector, negotiation of cooperative endeavor agreements, negotiation and closing on servitude acquisitions, and assistance with government relations and regulatory matters.
• Counsel for natural gas pipeline company in connection with the construction, development, and permitting of a $1 billion natural gas pipeline expansion providing advices with respect to negotiation of, and closing on, fee and servitude acquisitions in connection with related pipelines, interconnect facilities, metering and compressor sites, review of title matters, permitting, and governmental relations.
• Counsel for natural gas storage company in connection with financing, construction, development, and permitting of a $250 million salt cavern natural gas storage facility providing advices with respect to $120 million credit facility and related financing documents, negotiation of and closing on fee, leasehold, options and servitude acquisitions in connection with related pipelines, pipeline facilities, storage caverns, salt water disposal wells and leaching facilities, review of all title matters, negotiation of pipeline construction contract, assistance with permitting, obtaining water rights and addressing related issues, and assistance with governmental relations, and expropriation/condemnation proceedings for pipeline right-of-way.
• Counsel for a natural gas storage company in connection with the conversion, permitting, construction, and development of a depleted reservoir natural gas storage facility, including all aspects of the regulatory proceeding to convert the reservoir to storage, one of only two such conversions in Louisiana since 1979.
• Counsel to natural gas gathering, processing, and storage company addressing regulatory variance issues before the Louisiana Department of Natural Resources.
