Neely Griffith is a partner in the Business & Commercial Litigation Practice Group and is a member of the firm's Corporate Investigations & White Collar Defense practice. She regularly represents clients before government regulatory and enforcement agencies, as well as the courts. Ms. Griffith actively represents corporations and their officers, directors, and employees in internal investigations, administrative enforcement proceedings, including U.S. Securities and Exchange Commission (SEC) proceedings, and other government investigations. In her practice, she advises corporate audit committees, general counsel, and compliance officers in responding to government subpoenas and internal complaints, and in instituting preventative policies, internal controls, and training measures necessary to remain in compliance with relevant laws and regulations.
In addition to her compliance and government enforcement work, Ms. Griffith has represented clients in multi-district litigation, as well as Racketeer Influenced and Corrupt Organizations Act (RICO) and securities lawsuits. Her recent significant engagements include:
- Conducting an internal investigation regarding the Medicare billing practices of a large health care system and assisting and advising the client in connection with self-disclosure to the government;
- Defending a major offshore oil industry service provider in connection with RICO allegations related to hiring practices;
- Defending a publicly traded company against allegations by the SEC arising from corporate revenue recognition policies;
- Assisting a large health care system in the development and implementation of a comprehensive compliance program, including the establishment of training measures, policies, and internal and external controls;
- Defending a publicly traded company against allegations by the SEC arising from corporate accounting for long-lived assets;
- Defending a securities broker-dealer against allegations brought by the National Association Of Securities Dealers (NASD) related to employee supervision; and
- Defending multi-million-dollar welding industry clients in connection with multi-district litigation centered in the Northern District of Ohio.
