Amy Winters is a partner in the Litigation Practice Group. She focuses on healthcare industry and general litigation.


Amy advises health plans and all types of healthcare providers, including physicians, dentists, psychologists, counselors, nurses, hospitals, hospice providers, and long-term care facilities. Drawing on more than 30 years of legal experience, Amy defends providers in licensing and credentialing matters in state and federal courts, as well as administrative proceedings before hospital peer review committees and licensing boards. She also defends healthcare providers in medical professional liability actions, including malpractice and privacy actions, and in contract disputes involving practice separation and restrictive covenants.

Amy provides advice and counsel in connection with healthcare regulatory and compliance matters to health plans and healthcare providers. She assists healthcare providers with contracting matters, including drafting and negotiation of employment and professional services agreements and medical director agreements. She also provides guidance to healthcare providers and health plans regarding payor-provider relations, contracts, and reimbursement.

Amy assists covered entities and business associates to create comprehensive HIPAA compliance programs. In this context, she works with her clients to assess and develop customized privacy and security practices, as well as related policies and procedures that comply with HIPAA standards. She drafts and negotiates business associate agreements for covered entities, business associates, and subcontractors. Amy also advises clients throughout the course of HIPAA breach investigations and responses, including breach notification reports to individuals and regulatory authorities.

Amy also defends a range of clients in general litigation matters such as personal injury, property damage, products liability, and environmental and toxic torts.
