Attorneys recognized in Chambers USA 2012 for Energy & Natural Resources: Utilities.
As the energy industry evolves and expands with changes in technology, legislation and regulation, power generation companies, and utilities rely on our depth and breadth of experience and resources to address their legal needs. We
regularly represent project contractors, owners and operators in the development and financing of domestic and international power and transmission projects.
Our experience includes negotiation and documentation of power project agreements for owning and operating power plants and transmission systems, from simple and combined-cycle thermal generation, cogeneration and hydroelectric projects, to facilities for high-voltage transmission systems. We assist with environmental site assessment issues and permitting, EPC contracts, and agreements relevant to operation and maintenance, long-term parts and service, power purchase and tolling, and fuel supply and transportation.
We also advise clients in matters related to land use and zoning, as well as the analysis of available tax abatements, the creation of free enterprise zones, NIMBY (not in my backyard) disputes, real estate and title work, and site selection and related concerns, including interconnection issues such as access to the transmission grid and the availability of fuel and water supplies.
Our electrical power generation and transmission project financing experience includes counseling and support in the drafting and negotiating of project documents, providing analysis of contractual and commercial risks, and assisting in the development of measures to effectively mitigate or hedge risks. Our lawyers advise our clients with handling financing term sheets, guaranties, letter of credit arrangements, and loan commitment letters, and with agreements in connection with credit facilities, hedging, equity support, security, and direct agreements with lenders, including consents, estoppels and subordinations.
Our attorneys and strategic partners also offer extensive experience representing clients before the Louisiana Public Service Commission (LPSC), the Mississippi Public Service Commission (MPSC), the Alabama Public Service Commission (APSC), and other regulatory bodies. We routinely handle utility rate cases, cost of service investigations, and complaint, rulemaking, and various other regulatory proceedings.
