Mark Adams, a partner in the Labor & Employment Practice Group, and Minia Bremenstul, an associate in the Labor & Employment Practice Group, were quoted in the HRLaws.com article "5th Circuit: Doctor on Contract Can’t Sue Hospital for Bias.” In the ruling, the US Fifth Circuit Court of Appeals states an African-American doctor’s race discrimination claims against a hospital failed because he was not an employee rather he had a contract with a separate entity to provide medical services at the hospital. Mark and Minia advise employers to “be warned, however, certain factors can tip the scale in the other direction and result in liability.”
