William M. Backstrom, Jr., a partner and leader of the firm's Tax & Estates Practice Group in the New Orleans office, was recently quoted in a Law360 article entitled "State Tax Cases to Watch in 2015." In the article, Mr. Backstrom discusses the need for clarity in tax reporting positions following the decision in Vodafone Americas Holdings Inc. v. Farr, which is currently pending appeal at the Tennessee Supreme Court. In Vodafone, the Court of Appeals of Tennessee affirmed the Tennessee Commissioner of Revenue's use of alternative apportionment to apportion Vodafone's receipts from wireless communication and data services using market-based sourcing instead of cost of performance.
