Emily Sides Bonds and Mac B. Greaves, both partners in the firm's Birmingham office, successfully obtained a preliminary injunction on behalf of the firm’s client, a franchisor of sports-themed restaurants ("the plaintiff"). The plaintiff terminated its franchise agreement with the franchisee ("the defendant"). The franchisee then continued to operate and did not de-identify its restaurants in accordance with the franchise agreement. On August 28, 2015, the United States District Court for the Northern District of Alabama issued a preliminary injunction to require the franchisee to de-identify the restaurants and ordered the company to stop its use of the plaintiff's trademark. The Court has given the plaintiff leave to prove its attorneys’ fees. Micah J. Fincher, an associate in the firm's Intellectual Property section in the New Orleans office, assisted with the briefing to the Court on the issue of whether the preliminary injunction was moot since the defendant had taken some limited actions to de-identify the restaurants.
