Defense Verdict Obtained in Disability Discrimination/Retaliation Case Tried by Kern and Chess

A Kansas City jury deliberated only one hour before returning a verdict in favor of Defendant AutoZone, Inc., on April 10, 2008. The plaintiff, a former AutoZone store manager who suffers from muscular dystrophy, filed suit against the company for disability discrimination and retaliation following his termination. He claimed that AutoZone failed to accommodate his medical condition and that he was discharged due to his disability and in retaliation for complaining about his alleged unfair treatment. In addition to his own testimony, the plaintiff called his treating physician and two former AutoZone employees to testify on his behalf. AutoZone presented several witnesses to support its legitimate, nondiscriminatory/nonretaliatory reasons for the plaintiff's discharge. Following a four day trial, the jury returned a defense verdict on all three claims brought by the plaintiff.
