Micah Fincher, an associate in the New Orleans office, co-authored an analysis of the Supreme Court case Mission Product Holdings, Inc. v. Tempnology, LLC that was published on the New Orleans Bar Association blog. The blog post explains explains the case and the Supreme Court’s final ruling, which reaffirms the general bankruptcy principle that rejection constitutes a breach of contract and the effect of the breach depends on the terms of the contract and applicable non-bankruptcy law. In the Mission Product case, the breach of contract shows the meeting between bankruptcy and intellectual property law.
