Hammons and Pickett Receive Defense Verdict and Damages on Counterclaim for Clarence Weatherspoon and 35 35 Entertainment

Chad J. Hammons, a partner, and Kaytie M. Pickett, an associate, both in the firm's Business & Commercial Litigation practice in the Jackson office, obtained a defense verdict, as well as damages on a counterclaim for Clarence Weatherspoon, former NBA basketball player, and his record label, 35 35 Entertainment. The verdict was returned after a six-day trial in the Circuit Court of Hinds County in Jackson, Mississippi, before Judge Tomie Green. The Jones Walker team, assisted by paralegal Cindy Hutson, together with co-counsel Edward Blackmon of Blackmon & Blackmon, defended Mr. Weatherspoon and his company against claims for unpaid royalties on the 2006 album Look at Me, which featured the hit single "Peanut Butter & Jelly." The plaintiffs claimed $52,000 in allegedly unpaid royalties, and also sought unspecified noneconomic damages and punitive damages. The jury awarded plaintiffs nothing, and awarded the defendants $25,000 on their counterclaim for breach of contract for expenses incurred during the production and promotion stage of the album.
