Horton, a partner on the firm's Healthcare team in the Birmingham office, was quoted in the Modern Healthcare article “UnitedHealth defeats federal Medicare Advantage suit.” Mr. Horton discusses the recently dismissed False Claims Act lawsuit in which the United States Department of Justice (DOJ) alleged that UnitedHealth and affiliated health plans inflated plan members’ risk scores to secure higher Medicare Advantage payments. Commenting on the DOJ amending its allegations against UnitedHealth, Mr. Horton says, “The judge's order is pretty clear about what it would take to amend the complaint in a way that would pass muster, and if DOJ can assemble the relevant details, an amendment would not seem difficult.” Please click here to read the article.
