Corporate Practice Group partner Dionne Rousseau and associate Emily Gauthier authored the article "How the Supreme Court's Recent Decisions on Affirmative Action Affect the Board" published by Directors & Boards on July 28, 2023. The article covers the recent Supreme Court decisions on the lawfulness of using affirmative action in college admissions and how the decisions impact board oversight of corporate diversity, equity, and inclusion (DEI) efforts in the workplace and on the board. Dionne and Emily explain that although the decisions do not directly address these programs, there are several factors for companies and boards to consider in order to maintain legal compliance and prepare for increased scrutiny of corporate DEI programs.
