Partners Adam Stone and Kaytie M. Pickett, together with associate Andrew S. Harris, all in the firm's Business & Commercial Litigation Practice Group in the Jackson office, recently prevailed on appeal before the Fifth Circuit Court of Appeals in Green Tree Servicing, L.L.C., et al v. Anthony Charles. The case began as a suit in the Southern District of Mississippi seeking to compel arbitration and stay a state court proceeding. After the Federal Court compelled arbitration and stayed the state court case, the Defendants appealed. Chief Judge Stewart, writing for the three Judge panel, held, as urged by the Appellee, that it did not have jurisdiction to hear the appeal. This ruling will positively impact numerous other pending appeals for the same clients.
