Andy Lee, co-chair of the firm’s Privacy & Data Security Team, was quoted in the Class Action Reporter article “ZAPPOS: Petition for Writ of Certiorari in Data Breach Case Nixed” about the US Supreme Court’s decision to decline settling a circuit split over what constitutes harm in data breaches and whether individuals who do not have concrete injury from a data breach are entitled to class action standing. Andy comments that plaintiffs in certain geographies can take class action lawsuits to courts that will recognize their standing without the need to show actual losses following a data breach.
