Maritime partner Bob Lemon successfully represented Teco Bulk Terminal LLC in a two day trial of a $3.4 million breach of contract claim brought by Associated Terminals LLC in the US District Court for the Eastern District of Louisiana. Teco Bulk operates a bulk cargo transfer and storage terminal at Mile 55 AHP Lower Mississippi River, at Davant, Louisiana. Teco Bulk installed a series of midstream mooring buoys at its terminal, and pursuant to a Bulk Cargo Transfer Operating Agreement, hired midstream stevedore Associated Terminals LLC to supply its floating cranes to offload ships at these buoys. Associated Terminals brought a $3.4 million claim for breach of contract and liquidated damages following Teco Bulk's termination of the contract. In a lengthy opinion, the District Court found Teco Bulk's interpretation of the contract to be reasonable, and held its termination of the contract to be proper in accordance with the contract's provisions. The District Court entered judgment in favor of Teco Bulk dismissing Associated's claims with prejudice.
