Sidney F. Lewis, V, partner in the firm’s Labor & Employment Practice Group, was recently highlighted in CCH Employment Law Daily for successfully arguing a case involving ADA and state law disability bias and harassment claims. In the case, Mr. Lewis represented the defendant, a former employer of the plaintiff, against allegations of the aforementioned claims. It was determined that because the employee had failed to exhaust her administrative remedies with respect to her Equal Employment Opportunity Commission reprisal claim, that the claim could not proceed. The court dismissed the employee’s claim under the state’s whistleblower law because it was determined that she had failed to show that the employer actually committed a violation of the law.
