A Louisiana court recently certified a statewide class action lawsuit challenging the constitutionality and funding of the Louisiana public defender system. Mark A. Cunningham, a partner in the firm’s Corporate Compliance and White Collar Defense Practice Group, is representing thirteen plaintiffs together with attorneys at Davis, Polk & Wardwell LLP and the Southern Poverty Law Center. The lawsuit, originally filed in February 2017, alleges that the state’s overburdened public defender system fails to provide adequate representation to indigent defendants.
