Lisa A. Reppeto, a partner, and Andrew S. Harris, an associate, in the firm’s Business & Commercial Litigation Practice Group, co-authored “Women in Products Liability: Strict Liability and Fraud – the Odd Couple of Products Liability Litigation” for the 14th Annual Women in Products Liability Regional Workshop held by the American Bar Association’s Section of Litigation Products Liability Committee in New York, NY, on November 15, 2013. Ms. Reppeto was also the moderator for the Consumer Fraud: Strict Liability and Fraud – the Odd Couple of Products Liability Litigation session, where a diverse group of panelists representing all players in this type of litigation discussed the increasing trend of consumer fraud claims in products liability cases. More and more, state statutes have been used in conjunction with (or instead of) traditional product liability theories in product cases, raising interesting issues of proof, burden and damages. The panel also explored unique legal issues and challenges that arise when fraud is alleged along with strict liability.
