Richard Tyler, a partner in the Litigation Practice Group in the New Orleans office, authored the article “Supreme Court to Schein Additional Light on Question of Who Decides Arbitrability,” published in Under Construction, the American Bar Association Forum on Construction Law newsletter. In the article, Rich examines the US Supreme Court case Henry Schein, Inc. v. Archer & White Sales, Inc., No. 19-963, in which the parties litigated the question of who decides the “gateway” issue of whether a dispute is arbitrable over a period of eight years, including two trips to the Court.
