Edward R. Shohat, partner, Monique Garcia, special counsel, and Jon May, special counsel, all members of the Business and Commercial Litigation Practice Group and based in the Miami office, recently completed a jury trial in the Circuit Court for Miami-Dade County, Florida, and obtained a unanimous jury verdict in favor of their client, a Venezuelan national. The plaintiff was suing his former attorney on counts of breach of fiduciary duty, fraud, and conversion emanating from the defendant's representation of both the plaintiff and the plaintiff's business partner in the separation of their jointly-held business assets. The plaintiff argued that the defendant had an impermissible conflict of interest representing both of them during the time when the business partner was a testifying witness for the government and against the plaintiff in their federal criminal case.
