Andy Lee, a partner and co-leader of the privacy, data strategy, and artificial intelligence team, and DJ Johnson, an associate on the commercial disputes team, co-authored the article "When ChatGPT Meets the Legal Hold: Federal Courts Rewrite Preservation Rules for the AI Era" published by Corporate Counsel on December 9, 2025. In the article, Andy and DJ discuss how AI-generated content, including prompts, outputs, and metadata, may now be treated as electronically stored information (ESI) and preserved immediately once litigation is reasonably anticipated following two recent federal rulings.
