Carmen Rodriguez is a partner in the Litigation Practice Group and a member of the Healthcare Industry Team. She focuses on clinical research compliance, healthcare transactions, and dispute resolution.
With more than 30 years of experience across a wide range of industries, Carmen brings a comprehensive perspective to her healthcare practice. Drawing on her multidisciplinary background in litigation, corporate transactions, and regulatory compliance, Carmen helps clients identify and avoid potential legal pitfalls before they develop into disputes. She serves as a strategic advisor to clinical research institutions, hospitals, health systems, and other providers, as well as insurers, helping them navigate complex federal and state regulatory frameworks while structuring sound contractual and other business relationships.
Carmen’s healthcare practice encompasses Health Insurance Portability and Accountability Act (HIPAA) compliance, machine learning (artificial intelligence) applications, Food and Drug Administration (FDA) regulatory matters, and value-based billing structures. She leverages her extensive experience in complex litigation, as well as disputes involving federal, state, and local government agencies and businesses of all types, to develop and deliver solutions that mitigate risks and enable her clients to focus on their core objectives.
Carmen’s experience as an attorney includes service on both sides of the bench: Early in her career, she served as a judicial law clerk for two different federal judges and was appointed deputy special master in a product liability multi-district litigation concerning claims about the diabetes medication Actos (pioglitazone). Carmen has also represented clients in a number of disputes with federal and state agencies, departments, and boards of commissioners. Her experience across these disparate dimensions informs her approach to healthcare regulatory compliance and dispute resolution, enabling her to anticipate potential challenges and develop proactive strategies that protect her clients’ interests.
In addition to her healthcare work, Carmen maintains a robust practice representing clients in energy, environmental, and commercial disputes. She has considerable experience handling all aspects of complex litigation, including legal analysis, case management, discovery (including electronically stored information and the most current use of machine learning), privilege review, motions, and other areas of practice.
