Tony Shaw is a partner in the Litigation Practice Group and co-leader of the CMBS and creditors’ rights team. He primarily represents banks and private lenders.
Tony represents financial institutions, including banks and private equity funds, in a broad range of workouts, litigation, trials, and arbitrations across the country.
With extensive experience in bankruptcy and creditors’ rights, Tony has litigated numerous cases to verdict, successfully handling bench and jury trials in courts nationwide. His recent work includes representing commercial mortgage-backed securities (CMBS) special servicers and financial institutions in complex bankruptcy matters in states such as Arkansas, Florida, New York, and Texas.
Recently, Tony represented a foreign telecom company to provide guidance in handling a billion-dollar-plus fine issued by a Middle Eastern government, as well as work out a 10-figure arbitration award issued by the International Court of Arbitration in Paris.
His practice covers a wide spectrum of bankruptcy and creditors’ rights issues, including workouts, fraudulent conveyance actions, alter-ego claims, corporate veil piercing, and post-judgment collections. Tony has helped clients recover hundreds of millions of dollars in assets, securing numerous six-, seven-, and eight-figure judgments and settlements for creditors.
Licensed to represent clients in both state and federal courts across Alabama, Florida, Georgia, Mississippi, New York, Tennessee, Texas, and Virginia, he routinely counsels clients concerning workouts and loan restructuring, and advises creditors in Chapter 7, 11, 12, and 13 bankruptcy proceedings regarding preference actions, administrative expenses, executory contracts, and the automatic stay.
In addition to his litigation and restructuring work, Tony has a strong appellate practice, having represented clients before the US Court of Appeals for the 11th Circuit; the Alabama, Florida, Georgia, and Mississippi supreme courts; and multiple lower appellate courts in Alabama, Florida, and Georgia. He has presented oral arguments in several state courts, including the Georgia Supreme Court. Tony also brings specialized knowledge involving the Perishable Agricultural Commodities Act (PACA), advising clients on its impact to produce debtors and creditors.
He has been quoted by Al.com, is a frequent speaker on bankruptcy and creditors’ rights issues, and has been published multiple times in national journals.
