Nicole Grimal Helmstetter is special counsel in the Litigation Practice Group and a member of the bankruptcy & restructuring team, where she helps clients navigate complex financial challenges and insolvency proceedings.

Nicole is a business bankruptcy attorney with extensive experience representing parties on all sides of insolvency matters involving distressed businesses, assets, and portfolios. She routinely represents debtors, creditors, and fiduciaries in federal and state court insolvency proceedings.

As a lifelong Miami resident, Nicole brings an in-depth understanding of the local business landscape and the unique opportunities and challenges that South Florida businesses and their creditors face in a rapidly changing market. A fluent Spanish speaker, she regularly counsels members of South Florida’s multinational business community and guides Spanish-speaking clients through restructuring, insolvency, and bankruptcy-related matters.

Although centered in Florida, Nicole’s practice is national in scope. She represents regional and mid-size businesses, nonprofits, lenders, fiduciaries, and creditors in Chapter 11 proceedings and assignments for the benefit of creditors, with a particular focus on the local commercial real estate market and retail/hospitality sectors.

Nicole is particularly skilled at helping businesses downsize while remaining operational and at negotiating mutually beneficial out-of-court workouts that keep parties out of bankruptcy altogether. She has successfully obtained confirmation of reorganization plans for a range of enterprises, including health and educational institutions and real estate companies, and has secured bankruptcy discharges for high-net-worth individuals and local business owners.

Nicole’s background also includes assisting purchasers of distressed assets and helping traditional lenders and private equity funds enforce their rights against collateral, execute on judgments or other collection efforts.

Her comprehensive approach to insolvency matters has earned her recognition from the American Bankruptcy Institute as a top “40 Under 40” honoree and consistent annual ranking in Chambers USA since 2024. Nicole also maintains a board certification in Business Bankruptcy Law by the American Board of Certification.
