Steven F. Casey, a partner, and David A. Lester, special counsel, both in the firm's Business & Commercial Litigation Practice Group in the Birmingham office, recently obtained a ruling from the Supreme Court of Alabama ordering the Circuit Court of Mobile County to dismiss a $5 million indemnity claim against a firm client that heat treats gears used in aircraft engines. The case arose from an aircraft crash in Oklahoma in which three people died. The appeal dealt with an issue of first impression under Alabama's conflicts of law doctrine. Specifically, the case turned on whether Alabama law must recognize another state's characterization of a substantive claim before applying an Alabama statute of limitation to the claim.
