Steven Casey is a partner in the Litigation Practice Group. He maintains a diverse practice not only representing clients in court, but also in counseling clients in avoiding and managing litigation risks.


Steve has extensive experience in the energy, pharmaceutical, chemical, banking, and aviation industries. He has litigated toxic tort, product liability, securities fraud, banking, ERISA, insurance, and contract cases. Steve’s trial experience has allowed him to develop skill in assisting clients in finding creative solutions for complex business disputes.

Steve has defended clients in mass toxic tort matters and class actions involving both mercury and polyfluorinated alkyl systems (PFAS), where claims have been made for personal injury, property damage and water pollution. Steve also successfully defended a generic pharmaceutical manufacturer in the first and only failure to warn case to go to trial in the United States involving the drug metoclopramide (Reglan®).

Steve has served as national counsel for major pharmaceutical manufacturers in litigation involving several of their products and as regional counsel for many others. He represented some of those same manufacturers in Average Wholesale Pricing litigation in several states. He has also served as regional counsel for a well-known insurance company in its life, disability and ERISA litigation. Additionally, Steve has represented companies in approximately a dozen cases involving airplane crashes and products liability.

In addition to his litigation practice, Steve has served as mediator and arbitrator in a variety of matters and has developed a niche practice representing more than 60 homeowner associations in virtually all aspects of their operations and formation. He also served as lead counsel for the shoreline management group of Alabama’s largest public utility for more than 30 years and has tried numerous eminent domain cases to juries across the state.

Experience

  • Obtained a defense verdict for a generic pharmaceutical manufacturer in the first failure-to-warn case tried in the US involving the drug metoclopramide (Reglan®). (Green v. Morton Grove)
  • Obtained a defense verdict in a double wrongful death case in which the decedents' TV antenna contacted overhead electrical facilities (Burch v. Central Alabama Electric Cooperative)
  • Obtained a successful result in a case where the plaintiff was burned when his sailboat mast contacted the overhead power line of an electric utility
  • Obtained a defense verdict in a breach-of-contract/warranty case involving a commercial building package (All Seasons Heating & Cooling v. Butler Manufacturing)
  • Obtained a successful confidential settlement in litigation with more than 1,200 plaintiffs alleging property damage inflicted by air emissions from manufacturing facilities (Lowery v. Butler Manufacturing)
  • Negotiated a favorable settlement involving a claim against a supplier of materials used in the construction of an animation studio at Disney World (Hoar Construction v. Butler Manufacturing)
  • Obtained a record jury verdict for the plaintiff in a wrongful death case arising out of a motorcycle/flatbed truck collision (Lombus v. Valley Building Supply)
  • Negotiated a successful confidential settlement in a wrongful death matter arising out of an aviation accident in which the pilot and two passengers died
  • Obtained a jury verdict in federal court in Georgia for the manufacturer of a well-known energy drink in a case where plaintiff claimed the product caused her to have a heart attack
  • Received a significant jury verdict for a minor plaintiff who was assaulted on her high school campus by other students
