Nicole Grimal Helmstetter, special counsel and a member of the bankruptcy & restructuring team in the Miami office, served on a "Bankruptcy & Ethics" CLE panel on April 29, 2026, for the Bankruptcy Bar Association (BBA) of the Southern District of Florida. Nicole, together with the Honorable Robert Mark of the US Bankruptcy Court for the Southern District of Florida, Anthony Alfiere, a professor of law at the University of Miami, and David Samole of Kozyak Tropin Throckmorton, discussed the key ethical challenges arising in bankruptcy and related litigation matters. The panel examined topics such as the limits of trial publicity, attorneys' responsibilities in insolvency filing approaches, and issues surrounding privilege and withdrawal when clients accuse counsel of wrongdoing. The discussion also addressed law firm oversight obligations and the ethical boundaries implicated in pursuing sanctions motions.
