Jones Walker attorneys secured a complete defense verdict in favor of four clients following a seven-day bench trial before Judge Schwartz in the 22nd JDC. The case involved two competing businesses in the freight-brokering industry, with the plaintiff claiming over $26,000,000 in damages from alleged unfair trade practices, trade secret misappropriation, and breach of fiduciary duties. The Judge found zero liability on behalf of Jones Walker's clients and awarded zero in recovery. The Judge also found that the Jones Walker trial team successfully proved that the plaintiff withheld and spoliated evidence, awarding the costs incurred — which included assistance from a computer forensic expert — to recover some of the withheld evidence. Labor and Employment partners Joseph F. Lavigne and P.J. Kee tried the case, and they were assisted by associates Jason A. Culotta and Michael A. Foley and Litigation Support Specialist Aaron Washington.
