Partners, Thomas P. Hubert and P.J. Kee, together with associates Micah J. Fincher and Michael A. Foley, successfully obtained a preliminary injunction after an evidentiary hearing and extensive briefing before the United States District Court for the Eastern District of Louisiana. Firm clients were embroiled in a dispute after a tech support company threatened to terminate the firm clients' email accounts and websites, which would have effectively shut down their ability to communicate with customers. The Jones Walker team filed a lawsuit, seeking relief under the Anti-Cybersquatting Consumer Protection Act and for breach of contract and fiduciary duties. The team was previously successful in obtaining a temporary restraining order that prevented the tech support company from interrupting the client’s websites or email accounts — and now, the preliminary injunction requires the tech company and domain name registrar to transfer control of the domain names and email accounts back to the firm clients.
