Trade secret team attorneys Tom Hubert, Joe Lavigne, P.J. Kee, Michael Foley, and Jason Culotta obtained a preliminary injunction for firm client Brock Services, LLC, which was upheld on appeal in a published decision rendered by the US Fifth Circuit Court of Appeals. A Brock employee in Louisiana resigned suddenly and started working for a direct competitor, soliciting work from existing Brock clients. The legal team obtained testimony from the former employee and other witnesses regarding the scope of restrictive covenants the employee had entered into with Brock. The district court accepted parole evidence after finding the restrictive covenants ambiguous and denied the employee’s request to exclude forensic evidence gathered in discovery, which demonstrates he was working in restricted parishes and entered a preliminary injunction further restricting him from competition. The legal team conducted expedited discovery that included a forensic investigation, participated in two preliminary injunction hearings, and successfully briefed and argued novel legal issues both to the district court and the appellate court. The appellate court decision was highlighted in an article written for Law360 in which Tom was quoted as lead attorney.
