Christopher Hinsley is a real estate and finance partner in the Corporate Practice Group. His practice includes coordinating, negotiating, and closing a wide variety of commercial financings and transactions, including multifamily and affordable housing transactions, as well as resolution of complex title and land use issues.


Chris has extensive experience representing institutional and non-traditional lenders, real estate investment firms, corporations, developers, lessees/lessors, and high-net-worth individuals in a wide range of commercial and residential real estate, finance, acquisition, disposition, and restructuring/distressed asset transactions in the state of Florida, as well as throughout the United States and internationally. 

Chris works with all types of real estate and real estate-related collateral, including unimproved and agricultural lands, residential properties, condominiums, multifamily apartments, assisted living facilities, marinas, submerged lands, mixed-use facilities, shopping centers, offices, industrial buildings, power plants, foreign properties, and non-real estate corporate assets.

In addition, Chris represents acquirers and investors, as lead counsel, in connection with the acquisition, disposition, and financing of affordable housing and senior housing, which representation requires significant state and federal affordable housing regulatory experience and work with low-income housing tax credits.

Chris’ experience includes all manner of real estate financings and acquisitions, including multifamily lending, condominium finance, ground leasehold transactions, construction loans and development projects, residential lending, loan participations, multi-jurisdictional and foreign transactions, and mezzanine financing. He has significant experience in commercial leasing arrangements, service, management, and construction contracts, corporate filings and agreements, local counsel opinions, zoning and entitlement issues, and purchase and sale negotiations.

With respect to the restructuring and management of distressed assets, Chris assists clients with the negotiation and implementation of forbearance arrangements and similar foreclosure-related restructurings, stipulated settlements, sales of loan assets, REO property sales, deed in lieu transactions, loan modifications, bankruptcy-related workouts, lease negotiations, and other credit modification and property management activities.

Experience

  • Assisted developer in connection with negotiation, structuring, and closing of institutional construction loan financing, together with preferred equity investment and additional limited partnership investment for construction of mixed use residential project consisting of approximately 280 residential apartments and 5,200 square feet of commercial retail space and parking facilities.

  • Assisted a national affordable housing property investment company with acquisition of various multifamily properties within and outside of the state of Florida
  • Assisted an institutional investor with a new mortgage loan financing secured by a multifamily property
  • Assisted a power company affiliate as its Florida local counsel in connection with emplacement and subsequent modification of a commodity swap transaction secured by a Florida industrial property
  • Assisted a regional lender in a bankruptcy-related settlement and deed in lieu of a disposition of loan facilities on properties located in multiple US jurisdictions and the Bahamas
  • Assisted a real estate developer with obtaining equity investment for construction and development of real estate projects in Florida
  • Assisted various clients in connection with the sales of Florida loan facilities
  • Assisted a business owner in connection with the sale of all assets
  • Assisted a community bank in its stipulation to the agreed foreclosure of a shopping center and with the related leasing and property management
  • Assisted a national bank in reaffirming and insuring a leasehold title to foreclosed office property
  • Assisted a lender with a multi-facility real estate and inventory-secured loan to a manufacturer, involving an amendment to the existing line, a new equipment line of credit, purchases of indebtedness, and additional mortgage loans
  • Assisted a national company in connection with its acquisition, permitting, and development of an industrial property
  • Assisted a national institutional lender in the modification of a mortgage loan secured by assisted living facilities located in Florida
  • Assisted out-of-state investors in connection with the sale of Florida real property and the assignment of loan obligations
  • Assisted a regional institutional lender in connection with the post-levy registration and confirmation of ownership rights to an airplane collateral
  • Assisted various US-domestic and foreign high-net-worth individuals in the refinancing, purchase, and sale of condominium properties and luxury residences
  • Assisted landlords and tenants in connection with the drafting and negotiation of office and bank branch leases
