Construction

From conception to completion: Jones Walker’s Construction Team helps clients manage all elements of a successful construction project.

Time is money in any business enterprise, but construction projects give rise to particular challenges. Projects may be long and complex, and each step in the process can generate specific issues and opportunities that must be identified and addressed within very short time frames.

Our work is directly tied to our clients’ business goals. Whether or not construction is your business’s primary focus, Jones Walker is ready to help you develop, manage, and complete your construction project. Our attorneys’ extensive soup-to-nuts experience in all manner of construction projects, including industrial, healthcare, manufacturing, aviation, heavy civil, stadiums, commercial, retail, distribution, office, residential, and mixed-use assets, helps ensure that projects are completed on time, on budget, within scope, and to your satisfaction.

We are recognized as a leading construction practice by Chambers USA, The Best Lawyers in America©, The Legal 500, Super Lawyers, The International Who’s Who of Business Lawyers, and The International Who’s Who of Construction Lawyers. Members of our team have been trained in and practiced in numerous construction- and design-related disciplines, and we continue to actively support and participate in a broad range of relevant legal and trade organizations.

We provide real-time advice to international and domestic businesses, owners, contractors, architects, design professionals, and builders on issues that arise at every step on the design and construction timeline, including:

  • Site selection
  • Project finance
  • Permitting and licensing
  • Bidding
  • Negotiation of contracts
  • Contract administration
  • Insurance coverage
  • Dispute prevention and resolution, including litigation and arbitration

Our global presence is as extensive as our services. We represent clients across the United States, Europe, Asia, South America, Central America, Australia, and Africa on large-scale construction and infrastructure projects. Such major projects often have a significant government component; we provide counsel on US and international procurement and government contracting regulations, economic development funding, tax incentives, and public-private partnerships.

This experience with federal, state, and local government contracts has made us a go-to practice for international and domestic contractors — including qualifying disadvantaged, minority, and veteran business organizations — seeking assistance as they navigate the complex process of bidding for, winning, and fulfilling contracts with public entities. We have counseled clients on a broad range of claims arising under these contracts, including analysis of the following:

  • Entitlement and claims pricing issues
  • Claim notification and certification requirements
  • Contract Disputes Act claims
  • False Claims Act investigations
  • Miller Act Claims
  • Tucker Act Claims

We also have experience prosecuting and defending public contracts under state procurement laws in Florida, Georgia, Louisiana, and Texas. In addition, we appear before the US Government Accountability Office (GAO), Court of Federal Claims, and Boards of Contract Appeals in connection with federal procurement disputes.

With the support of the firm’s other practices, we advise on environmental regulation and permitting, real estate acquisitions, sales and leasing, project finance, labor and employment, taxation, government relations, and many other areas of law that play a role in the successful planning and execution of projects.

Our construction litigators help clients identify potential risks and minimize the likelihood of disputes with contractors, owners, subcontractors, vendors, and governmental agencies. When conflicts do arise, these talented lawyers draw on their many years of experience litigating billions of dollars in construction disputes in state and federal courts, in arbitration, and before administrative and industry panels worldwide. Members of our team are themselves highly trained, registered mediators and arbitrators, and several serve as neutrals for the American Arbitration Association.

Over the past decades, we have advised clients on an impressive range of construction projects. We have developed specific experience in the following:

  • Aerospace, including airports and aviation manufacturing facilities
  • Energy, including oil and gas production and pipelines; complexes producing polyethylene, polypropylene, polymer, and ethylene glycol; power plants; data centers; wind farms; and related facilities
  • Healthcare, including mega-hospitals, clinics, and other healthcare facilities
  • Maritime, including shipyards, terminals, ports, locks, and dams
  • Transportation, including roads, bridges, tunnels, interstates, highways, locomotive maintenance, rail yards, and track construction
  • Sports and entertainment, including stadiums and other athletic facilities, live-performance properties, and recording studios
