Dan McGinn is special counsel in the Tax Practice Group primarily assisting entities in the gaming and alcoholic beverage industries obtain and maintain compliance with state and federal regulations.


Dan counsels clients on a broad range of regulatory compliance and legislative advocacy matters, with an emphasis on issues involving Florida’s Division of Alcoholic Beverages and Tobacco, which is tasked with the enforcement of numerous laws and regulations — including Prohibition-era codes — that have failed to keep pace with the demands of innovation-focused industries and businesses. He also practices before Florida’s Gaming Control Commission, advocating for sensible gaming regulation and fair application of the prohibitions against illegal gambling.

Drawing on his experience and deep knowledge of relevant regulatory frameworks, Dan devises creative solutions for his clients’ concerns and helps them achieve desired outcomes. Among other matters, he has crafted language to permanently legalize “cocktails-to-go” following the shutdown and reopening of alcoholic beverage vendors in 2020, helped build the internal policies and practices necessary to incorporate the sale of nicotine products into the division’s regulatory sphere, and championed a mandate requiring the use of electronic filing for excise and surcharge tax reporting. Dan also represented the state in a matter preventing the proliferation of gray-market slot machines and argued on behalf of interested parties against Florida’s Voter Control of Gambling amendment. Additionally, Dan has been very active in assisting regulated entities and private equity firms in exploring and evaluating opportunities in regulated industries and handling complex internal investigations.

Dan also represents businesses and individuals before Florida’s Department of Revenue and in courts throughout Florida in state and local tax matters.
