Jeff Barber is a partner in the Litigation Practice Group and head of the firm’s Mississippi office. He focuses on bankruptcy and creditors’ rights.


Jeff represents secured and unsecured creditors, committees of unsecured creditors, trustees, debtors, business owners, and other clients in a broad range of bankruptcy proceedings, reorganizations, workouts, and restructurings. He has served as national and local counsel for clients across the southeastern United States and beyond with operations and investments in a broad range of industries, including financial services, healthcare, real estate, and energy (including oil and gas exploration, production, and distribution).

Recognized by Chambers USA, The Best Lawyers in America®, and Benchmark Litigation, among other leading ratings agencies and legal journals, he argued the first appeal in the country of a cross-border insolvency case under Chapter 15 of the US Bankruptcy Code. 

In addition to his extensive litigation experience, Jeff is a graduate of the St. John’s University/American Bankruptcy Institute’s (ABI) Bankruptcy Mediation Training program and has served as a court-appointed mediator. He draws on his substantive industry experience and works closely with in-house counsel and key business leaders to develop effective dispute resolution strategies and pursue client objectives in the most appropriate manner, whether in court, in mediation, or in other settlement negotiations.

Jeff has served as an adjunct professor of debtor-creditor law at the Mississippi College School of Law. He also lectures frequently on bankruptcy and creditors’ rights matters and is the author of dozens of published articles, book chapters, and treatises.

Experience

Insurance and Financial Services

  • Represented the Chapter 11 trustee of a residential mortgage loan servicing company following the theft of more than $9 million from debtor-in-possession accounts, along with corporate books and records, and the transfer of such assets to countries in Latin America.
  • Represented an unsecured creditors committee in a Chapter 11 case involving allegations that the debtor stole in excess of $140 million from 13 corporate payroll processing entities he owned, each of which were also in Chapter 11.
  • Represented a foreign insurance company as the defendant in a $150 million Chapter 15 adversary proceeding and subsequent circuit court appeal — the first in the country.

Energy

  • Represented foreign entities whose $2 billion of deep-sea drilling rigs were being fabricated by shipyard/vessel fabricating companies that filed Chapter 11 proceedings; later represented the same foreign entities in a Section 363 purchase of the divisions of Chapter 11 debtors.
  • Represented the Chapter 11 trustee in the restructuring of an oil and gas company’s operating wells and multiple gas processing refineries in a Chapter 11 bankruptcy case.
  • Represented an international offshore drilling contractor as a debtor in a pre-negotiated Chapter 11 bankruptcy case involving the restructuring of approximately $1.1 billion in funded debt.

Agriculture

  • Represented crop production lenders in a Chapter 11 grain elevator proceeding involving the rarely used expedited provisions of Section 557 of the Bankruptcy Code to litigate competing claims under Articles 2, 7, and 9 of the Uniform Commercial Code; the federal Food Security Act; and state grain elevator statutes and regulations.
  • Represented a lender as a participant in a combined $80 million new market tax credit transaction and secured lending arrangement in Chapter 11 proceedings of owners and lessees of a peanut processing plant.

Healthcare

  • Represented a hospital facility as a counterparty to an executory contract in Chapter 11 proceedings of specialty medical services providers with more than 900 facilities in the continental United States.
  • Represented the Chapter 7 trustee of a medical laboratory facility in prosecuting more than 130 fraudulent transfer adversary proceedings.
