Etienne Balart is a partner in the Maritime and Litigation practice groups and a member of the Construction Team. He co-leads the firm’s Latin America working group.


Etienne provides transactional, dispute resolution, and litigation counsel to a variety of clients in the energy, maritime, and construction industries, helping them navigate financial, compliance, and risk management challenges. His almost three decades of experience includes drafting and negotiating construction agreements, master service contracts, vessel charter parties, and other contracts, as well as advising clients on regulatory compliance, certification, and maritime documentation issues.

Etienne has litigated extensively in multiple jurisdictions, both federal and state, and before domestic and international arbitration panels, bringing a pragmatic and solution-oriented approach to disputes. His litigation experience spans commercial disputes, construction claims, contract terminations, surety claims, insurance coverage issues, vessel seizures, maritime personal injuries, multi- and single-claimant limitation of liability actions, third-party state and Outer Continental Shelf platform claims, vessel collisions and allisions, indemnity disputes and applications of anti-indemnity statutes, and cargo claims. Etienne also has significant appellate experience, having clerked for the Honorable W. Eugene Davis of the US Court of Appeals for the Fifth Circuit, and later representing clients in appeals before that court and the courts of appeal in Louisiana.

Beyond his maritime and energy practice, Etienne advises owners, general contractors, and subcontractors on construction litigation and commercial disputes, including Louisiana Public Bid Law matters. He has handled arbitrations and court cases involving contract terminations, cost overruns, design defects, contract delays, and payment disputes.

Experience

  • NASDI, LLC v. Bertucci Contracting Company, LLC (State of Louisiana, 24th Judicial District Court). Lead trial counsel in a multimillion-dollar construction dispute arising out of a state project that was tried for two weeks to a jury in Jefferson Parish.
  • Dominion Exploration & Production, Inc. v. Delmar Systems, Inc. (Eastern District of Louisiana). Co-counsel on behalf of client asserting damages on behalf of well owners and operators resulting from the emergency disconnect of a mobile offshore drilling unit from the well.
  • Durr v. City of New Orleans (State of Louisiana, Civil District Court). Represented client in public bid law dispute arising out of public bidding of street construction project.
  • In re Parker Drilling Offshore USA, LLC (Eastern District of Louisiana). Represented client in multi-district litigation arising from collapse of a rig offshore, including a multi-claimant limitation of liability proceeding in federal court involving property damage and personal injury claims.
  • Grefer v. Travelers et al. (State of Louisiana, 24th Judicial District Court). Represented client in an insurance coverage litigation involving NORM-associated liabilities for a domestic insurer arising out of a civil jury verdict.
  • Hyundai (USA) Corp. v. Combined Transport et al. (S.D. Ohio, C-1-99-826). Lead counsel in a commercial maritime dispute involving shipment of steel product from overseas. Lead trial counsel in bench trial.
